Right of Withdrawal & Cancellation Form

Under the EU Consumer Rights Directive 2011/83/EU, the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the UK Digital Markets, Competition and Consumers Act 2024 (DMCC Act), consumers purchasing from AL-GHANI NURNET LTD (our UK entity) or our EU-serving entity have the right to withdraw from a contract within 14 calendar days of purchase without giving any reason. This page explains your rights and provides a model cancellation form.

1. Your Statutory Rights

1.1You have the right to withdraw from any contract with HostupCloud within 14 calendar days of placing your order, without giving any reason.

1.2The 14-day withdrawal period begins on the day you receive our order confirmation email.

1.3You do not need to pay any penalty or cancellation fee to exercise this right, except where the exceptions in Section 3 apply.

1.4This right applies to consumers (natural persons acting outside their trade, business or profession) purchasing from AL-GHANI NURNET LTD (UK) or via our EU-directed sales.

1.5Business customers (VAT-registered entities) purchasing under a business account do not have a statutory right of withdrawal under UK/EU consumer law.

1.6If you exercise this right, we will refund all payments received, including any setup fees, within 14 days of receiving your cancellation notice.

2. Eligibility Criteria

2.1You are a natural person (individual), not a company or business entity

2.2You are a resident of the European Economic Area (EEA) or the United Kingdom

2.3You placed the order within the last 14 calendar days

2.4The service has not been fully performed with your prior express consent (see Section 3)

2.5You have not explicitly waived your right of withdrawal in writing at the time of purchase

2.6The product or service is not in one of the excluded categories listed in Section 3

Reseller/affiliate customers must pass the consumer right of withdrawal to their end-customers where applicable under their national law.

3. Exceptions — When Withdrawal Does Not Apply

Under Article 16 of the EU Directive and equivalent UK Regulations, the right of withdrawal is excluded for:

Fully Performed Digital Services

If you expressly consented to us beginning performance immediately and acknowledged the loss of withdrawal right, and we have fully delivered the service (e.g. a VPS provisioned and used).

Domain Name Registrations

Domain registrations are immediately registered with the registry upon payment and cannot be reversed. No right of withdrawal applies.

SSL / TLS Certificates

Once issued, an SSL certificate has been delivered in full. No right of withdrawal applies after issuance.

Bare Metal / Dedicated Servers

Physical hardware allocated exclusively to you is excluded from withdrawal rights, as setup and provisioning constitute performance.

Services with Waiver at Checkout

If during checkout you explicitly ticked the box acknowledging immediate commencement and waiving your withdrawal right, that waiver is valid.

4. How to Exercise Your Right of Withdrawal

You may exercise your right of withdrawal by any of the following methods:

Support Ticket

Open a ticket in your control panel stating you wish to withdraw under the EU/UK Withdrawal Directive

Registered Post

Send a signed letter to: AL-GHANI NURNET LTD, United Kingdom. Include your account email and order reference.

4.1Your withdrawal is effective from the date you send the notice, not from when we receive it.

4.2We will send you an acknowledgement by email within 1 business day of receiving your withdrawal notice.

4.3You must submit the cancellation within the 14-day window from your order confirmation date.

4.4We cannot accept verbal or phone withdrawals as they do not create a verifiable paper trail.

5. Refund After Withdrawal

5.1We will process the refund within 14 calendar days of receiving your withdrawal notice.

5.2Refunds are issued to the original payment method (credit/debit card, PayPal, bank transfer, etc.).

5.3If you used a credit card, the refund will appear on your next statement cycle (typically 3–10 business days depending on your card issuer).

5.4If you have partially used the service, we may deduct a proportional amount for the period of use prior to withdrawal.

5.5Refunds will not include third-party charges such as payment gateway fees (typically 2–3%) which are non-recoverable.

5.6Refunds for services used beyond 14 days are governed by our Refund Policy, not this withdrawal right.

5.7For partial withdrawals (e.g., withdrawing from one item in a bundle order), the refund covers only the withdrawn item.
