Cloud VPS Service Agreement

These terms govern the provision and use of HostupCloud Cloud VPS (Virtual Private Server) services. A Cloud VPS is a KVM-virtualised machine with dedicated vCPU, RAM, and NVMe SSD allocated exclusively to your instance — running on our shared physical infrastructure in Bangalore, India. These terms supplement the general System Policies and Acceptable Use Policy.

What is a Cloud VPS?

A Cloud VPS uses KVM (Kernel-based Virtual Machine) hypervisor technology to create isolated virtual machines on shared physical hardware. Your allocated vCPU, RAM, and NVMe SSD are reserved for your instance. Unlike shared hosting, you get root access and full OS control. Unlike bare metal, resources come from a pool — no single-tenant hardware guarantee.

Resource Policy

Resources shown on your plan are the guaranteed minimum allocation for your instance.

vCPU

Allocated cores are guaranteed. Burst CPU may be available on select plans during off-peak hours but is not guaranteed.

RAM

Fully allocated to your instance. No memory ballooning or overcommit. What you pay for is what you get.

NVMe SSD Storage

Allocated disk space is fixed per plan. Storage expansion available via additional volume add-ons.

Network / Bandwidth

1 Gbps port speed. Fair-use bandwidth policy — we do not hard-cap but monitor for abuse. No overage charges for normal usage.

Additional IPv4

Primary IPv4 included. Additional IPv4 addresses available at ₹ per month (limited availability; justification may be required).

IPv6

A /64 IPv6 subnet included at no charge on all Cloud VPS plans.

Snapshots & Backups

Snapshots

Manual

Point-in-time disk images you create on demand from the dashboard. Snapshots are stored separately from your instance. Charged per GB of snapshot storage used.

Automated Backups

Scheduled daily backups with configurable retention (7 or 30 days). Available as a paid add-on. Backups stored off-node for resilience.

Customer responsibility: HostupCloud is not liable for data loss. Snapshots and automated backups are a convenience feature — they do not replace a proper off-site backup strategy. We strongly recommend exporting critical data to HostupCloud Object Storage or an external provider regularly.

Network & Security

DDoS Protection

Layer 3/4 DDoS mitigation active at the network edge on all Cloud VPS instances at no extra charge.

Firewall

Cloud firewall available from the dashboard to control inbound/outbound traffic at the hypervisor level — before traffic reaches your OS.

Private Network

Private VLAN available to connect multiple VPS instances securely without traffic going over the public internet.

Floating IP

Reassignable public IP address. Useful for failover — point the floating IP to any VPS in the same data centre instantly.

5.1TLS 1.2+ enforced on all management interfaces (dashboard, API)
5.2Hypervisor-level isolation — your instance is fully isolated from other customers
5.3HostupCloud does not manage the firewall inside your OS — you are responsible for securing your VPS (SSH hardening, fail2ban, etc.)
5.4Default SSH password authentication is enabled on new instances — we strongly recommend switching to SSH key authentication immediately

Acceptable Use — Cloud VPS Specific

The general AUP applies. The following additional rules apply specifically to Cloud VPS.

Permitted

6.1Web servers, application servers, APIs, and microservices
6.2Database servers — MySQL, PostgreSQL, MongoDB, Redis
6.3Game servers and voice servers (TeamSpeak, Mumble)
6.4Development and CI/CD build environments
6.5VPN for your own organisation (not public proxy/VPN resale)
6.6Docker, LXC containers, and lightweight virtualisation within your VPS
6.7Tor relay nodes (non-exit) with prior written approval

Prohibited

6.8Spam, bulk email, or mail relay without approval
6.9DDoS attacks, port scanning, or network probing of third parties
6.10Cryptocurrency mining (CPU/GPU intensive mining)
6.11Malware, botnets, phishing, ransomware distribution or hosting
6.12Tor exit nodes — blocked at the network level
6.13Public VPN or proxy services sold to anonymise third-party traffic
6.14Nested hypervisors (running a full hypervisor inside your VPS — Type-1 virtualisation)
Violations result in immediate suspension without refund. Abuse reports are investigated within 24 hours. Report network abuse originating from HostupCloud IPs to abuse@hostupcloud.com.

7.1SLA covers network and hypervisor availability only — OS crashes, kernel panics, or misconfigurations inside your VPS are excluded
7.2Scheduled maintenance with 48 h advance notice is excluded from SLA calculations
7.3DDoS-induced downtime is excluded from SLA if originating from the customer's own traffic patterns
7.4SLA credits are applied as account credit — not cash refunds
7.5Claims must be submitted within 14 days of the incident via support ticket

Billing & Cancellation

Billing cycle

Monthly in advance. Invoice generated on your server start date each month.

Hourly billing

Available on select plans — billed per hour of use, capped at the monthly maximum. Useful for short-term workloads.

Scaling / resize

Resize to a larger plan at any time from the dashboard. Downgrade requires a reinstall. Price difference refunded pro-rata.

Cancellation

Cancel anytime for hourly-billed instances. Monthly instances require 30 days notice. Server deleted after notice period.

Non-payment

VPS suspended 3 days after invoice due date. Terminated and all data permanently deleted after 7 days of suspension.

Refunds

Cloud VPS is not covered by the 45-day money-back guarantee. Pro-rata refunds may be issued at HostupCloud's discretion.
