Terms and Conditions
These Terms and Conditions ("Terms") govern your use of all services provided by HostupCloud and its group entities. By creating an account, placing an order, or using any HostupCloud service, you agree to be bound by these Terms. Please read them carefully.

1. Parties
These Terms form a binding agreement between you ("Customer", "you", "your") and the relevant HostupCloud entity ("HostupCloud", "we", "us", "our") depending on your location and the services purchased:

2. Services
HostupCloud provides cloud infrastructure and hosting services including, but not limited to:
Service-specific terms supplement these general Terms. In case of conflict, service-specific terms prevail. Services are provided "as-is" and subject to availability.

All prices are listed in INR (Indian Rupee) unless otherwise stated. Prices are exclusive of applicable taxes (GST, VAT, etc.).
GST at the applicable rate is charged on invoices to Indian customers. UK VAT and US sales tax applied where required by law.
Credit/debit cards (Visa, Mastercard), UPI, net banking via Razorpay (India). International customers may use supported card networks.
Services renew automatically at the end of each billing period. You will receive a renewal reminder at least 7 days before the due date. UK customers: in compliance with the Digital Markets, Competition and Consumers Act 2024 (DMCC Act), you may cancel a subscription at any time with immediate effect during any renewal period.
If a payment fails, we will retry up to 3 times over 3 days. Service is suspended if payment is not received within 3 days of due date.
Tax invoices are issued electronically and available in your billing portal. GST invoices include HostupCloud's GSTIN: 29AAGCH5335N1Z2.
Refund Policy
5. Acceptable Use
Your use of HostupCloud services is governed by our System Policies & Acceptable Use Policy, which forms part of these Terms. Key restrictions include:
Violation results in immediate suspension without refund. We cooperate with law enforcement and may disclose account information pursuant to valid legal process. Report abuse to abuse@hostupcloud.com.
6. Intellectual Property
HostupCloud IP
All trademarks, logos, software (including HUCPanel), documentation, website content, and branding are the exclusive property of HostupCloud and its group entities. You may not copy, reproduce, modify, or distribute any HostupCloud intellectual property without prior written consent.
Your Content
You retain full ownership of all data, content, and intellectual property you store on HostupCloud infrastructure ("Customer Content"). You grant HostupCloud a limited, non-exclusive, revocable licence to host, store, and transmit Customer Content solely to provide the services. HostupCloud does not claim any ownership over Customer Content.
DMCA / Copyright Takedowns
We respect intellectual property rights. If you believe content hosted on our platform infringes your copyright, submit a valid DMCA takedown notice to our designated copyright agent at legal@hostupcloud.com. See our DMCA & Copyright Policy for required notice elements. We act within 72 hours of a valid notice.
7. Limitation of Liability
Please read this section carefully — it limits HostupCloud's liability to you.
Service Availability
HostupCloud provides services on a best-effort basis subject to the SLA. We do not guarantee uninterrupted, error-free service. Scheduled maintenance, force majeure events, and third-party infrastructure failures are excluded from liability.
Data Loss
HostupCloud is not liable for loss of Customer Content due to hardware failure, accidental deletion, software bugs, or any other cause. Customers are responsible for maintaining their own backups. Our backup features are a convenience service, not a guarantee.
Indirect Losses
To the maximum extent permitted by applicable law, HostupCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business, or goodwill — even if advised of the possibility of such damages.
Aggregate Cap
HostupCloud's total aggregate liability to you for any claims arising under these Terms, whether in contract, tort, or otherwise, shall not exceed the total amounts paid by you to HostupCloud in the 3-month period immediately preceding the event giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless HostupCloud, its group entities, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
9. Suspension & Termination
By You
You may cancel services at any time via the billing portal or by opening a support ticket. Cancellation notices for monthly services require 30 days. Data is deleted after the notice period expires.
By HostupCloud — For Cause
We may suspend or terminate your account immediately for AUP violations, non-payment, fraud, chargebacks, or providing false account information. No refund is issued.
By HostupCloud — Without Cause
We may terminate services with 30 days' written notice without cause. A pro-rata refund for the unused portion of any prepaid period will be issued.
Effect of Termination
Upon termination, your right to use services ceases immediately. All Customer Content is permanently deleted within 30 days. Certain provisions of these Terms survive termination.

The governing law applicable to your agreement depends on the contracting HostupCloud entity (see Section 1). Before initiating formal legal proceedings, both parties agree to attempt resolution in good faith through direct negotiation or mediation for a minimum of 30 days.
11. Changes to These Terms
HostupCloud may update these Terms from time to time to reflect changes in law, our services, or business practices. When we make material changes:
12. General Provisions
Entire Agreement. These Terms, together with service-specific terms, the Privacy Policy, and the System Policies, constitute the entire agreement between you and HostupCloud regarding the services and supersede all prior agreements.
Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver. HostupCloud's failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. HostupCloud may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure. Neither party shall be liable for delays or failures in performance resulting from causes beyond their reasonable control, including natural disasters, acts of government, pandemics, power failures, or third-party network outages.
Language. These Terms are written in English. Translations are provided for convenience only; the English version governs in case of any conflict.
