DMCA & Copyright Takedown Policy

HostupCloud respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) 17 U.S.C. § 512, the EU Copyright Directive (2019/790), the UK Copyright, Designs and Patents Act 1988 (as amended), India's Copyright Act 1957 (as amended by the Copyright (Amendment) Act 2012), and the Information Technology Act 2000 (s. 79). This policy describes how to submit a valid takedown notice, our counter-notice process, and our repeat-infringer policy.

1. Safe Harbour & ISP Status

1.1HostupCloud operates as an Internet Service Provider (ISP) and hosting provider. We provide hosting infrastructure; we do not create, review, or endorse content uploaded by our customers.
1.2As an ISP, HostupCloud qualifies for DMCA safe harbour provisions under 17 U.S.C. § 512(c) for content stored at the direction of a user, provided we expeditiously remove infringing content upon receipt of a valid DMCA notice.
1.3We similarly seek protection under equivalent safe harbour provisions in the UK (CDPA 1988 as amended) and India (Information Technology Act 2000, s. 79).
1.4Safe harbour status requires us to act on valid takedown notices and maintain a repeat-infringer termination policy, which we do.
1.5Safe harbour does not apply where HostupCloud has actual knowledge of infringement and fails to act, or where we receive a financial benefit directly attributable to the infringing activity.

2. How to Submit a Takedown Notice

Send your DMCA takedown notice to our designated copyright agent:

Initial acknowledgement within 24 hours; action within 72 hours of valid notice.

2.1Email is the fastest and preferred submission method for DMCA notices.
2.2Include 'DMCA Takedown Notice' in your subject line so it is routed to our legal team immediately.
2.3You will receive an automated acknowledgement within 4 hours and a response from our legal team within 24 hours on business days.
2.4We cannot accept DMCA notices by telephone, live chat, or social media. Written notices only.

3. Requirements for a Valid Takedown Notice

Under 17 U.S.C. § 512(c)(3), a valid DMCA takedown notice must contain all of the following:

3.1Your full legal name, address, telephone number, and email address (as the copyright owner or authorised agent).
3.2Identification of the copyrighted work(s) claimed to have been infringed (title, registration number, or URL of original work).
3.3Identification of the infringing material and its location — the exact URL(s) on our network where the infringing content is hosted.
3.4A statement that you have a good-faith belief that the use is not authorised by the copyright owner, agent, or law.
3.5A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised agent.
3.6Your electronic or physical signature.
3.7Incomplete notices missing any of the above required elements will be rejected and you will be notified of what is missing.
3.8Notices targeting entire websites or accounts without identifying specific infringing URLs are overbroad and will not be actioned.

4. Counter-Notice Process

If you believe your content was removed in error or that you have authorisation to use the content, you may submit a counter-notice under 17 U.S.C. § 512(g)(3) to legal@hostupcloud.com.

4.1Your counter-notice must include: your full name, address, phone number, and email.
4.2Identification of the material removed and its former URL.
4.3A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
4.4Consent to the jurisdiction of the Federal District Court for your judicial district (if in the US), or equivalent jurisdiction.
4.5Your electronic or physical signature.
4.6Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed content.
4.7We cannot offer legal advice on whether to submit a counter-notice. Consult your own legal counsel.

5. Repeat Infringer Policy

5.1A 'valid DMCA notice' for repeat-infringer tracking means a notice meeting all requirements in Section 3 that is not withdrawn by the complainant.
5.2Counter-notices that result in content restoration reset the infringement count for that specific piece of content.
5.3Accounts terminated under this policy are not eligible for refund of prepaid services.

6. Misuse of DMCA Process

6.1Submitting a DMCA notice with knowledge that the content is not infringing (false notice) is a federal offence under 17 U.S.C. § 512(f) and may result in civil liability including damages, costs, and attorneys' fees.
6.2We will not action notices clearly designed to remove lawful content, silence criticism, or suppress competition.
6.3Repeat filers of defective or bad-faith notices may be blocked from submitting future notices.
6.4We maintain a log of all DMCA notices received and actioned. We may publish aggregate transparency data about DMCA requests.
